  • Governor Bentley has appointed firm attorney Justin Smith to the University of West Alabama Board of Trustees. He was confirmed by the Alabama Senate on February 25, 2016 and will serve a six year term.

  • On January 22, 2016, firm attorney Dell Cross served on a Panel Discussion presented by Fellows of the American College of Trial Lawyers at the University of Alabama School of Law in Tuscaloosa. The topic was professionalism as required by the Alabama State Bar. In addition to Cross & Smith, the panel included the prominent Birmingham law firms of Lightfoot, Franklin & White, Marsh, Rickard & Bryan and Starnes Davis Florie.
  • During the fall of 2015, Cross & Smith settled several car accident cases in Tuscaloosa and surrounding areas for a total of $550,000.00.
  • The firm is investigating a products liability case to be filed in the Circuit Court of Limestone County involving the rollover of a utility vehicle. Our client suffered serious and permanent injuries as a result of the accident.

  • During the summer months of 2015, Cross & Smith settled several car accident cases for a total of $890,000.00. The accidents happened in Fayette, Jefferson, Montgomery, Tuscaloosa and Walker Counties in Alabama and in Forrest County, Mississippi.

  • Cross & Smith continues its pre-trial preparations for a bad faith insurance lawsuit to be set for trial in the Circuit Court of Sumter County in September 2014.
  • Two separate ATV (4-wheeler) cases have been filed by the firm arising out of severe injuries suffered by two minors who were involved in the accidents. One case involves a side rollover on a rural roadway (filed in the Circuit Court of Shelby County) and in the other the ATV flipped over backwards when the thumb-controlled throttle was engaged (filed in the Circuit Court of Tuscaloosa County).
  • The firm has settled an uninsured motorist case that was pending in the Circuit Court of Colbert County for $125,000.00 and a rear end car accident that happened in Cleburne County for $100,000.00.
  • A case arising out of a three car accident in Montgomery has been filed by the firm in the Circuit Court of Montgomery County, Alabama.

  • Cross & Smith settled four car accident cases last month for a total of $550,000.00. The cases occurred in Crenshaw, Sumter, Shelby and Tuscaloosa Counties.
  • The firm has filed a products liability case against the manufacturer and seller of an industrial parts washer that collapsed while our client was using it in the workplace. He suffered serious burns to his legs. The case is filed in the Circuit Court of Tuscaloosa County.

  • Cross & Smith has resolved six car accident cases this month for settlements that total in excess of $420,000.00. Three of these car accidents happened in Tuscaloosa, one accident happened in Montgomery, one accident happened in rural Lowndes County and one accident occurred in Meridian, Mississippi.
  • We have settled an uninsured motorist lawsuit that was filed in the Circuit Court of Butler County, Alabama. Our two clients were injured in a car accident that we alleged was caused by the negligence of an uninsured motorist.
  • Cross & Smith has filed a car accident lawsuit in the Circuit Court of Tuscaloosa County, Alabama. The other driver’s insurance company refused to pay its policy limits.
  • Our firm has recovered the maximum amount of liability insurance coverage and underinsured motorist coverage (UM) arising out of a car accident that happened in Tuscaloosa. The case was settled for these policy limits without the necessity of filing suit.
  • We obtained the maximum amount of liability insurance coverage available to our client as a result of a car accident that happened in rural Walker County, Alabama. We have filed suit against our client’s underinsured (UM) motorist carrier for the maximum amount of UM insurance coverage available. The lawsuit is filed in the Circuit Court of Franklin County, Alabama.
  • We have settled a breach of contract and bad faith insurance case that was filed in the Circuit Court of Hale County, Alabama. We recommended that our clients opt out of a class action settlement and file their own suit against the insurance company. They were denied multiple payments of additional benefits based on the insurance company’s interpretation of policy language. The amount of the settlement is confidential.
  • The firm has settled a workplace injury case involving the death of an employee who was killed while pressure testing a natural gas pipeline in rural Tuscaloosa County. The case was filed in the Circuit Court of Tuscaloosa County and was settled the week before trial. The amount of the settlement is confidential.
  • Cross & Smith has filed suit on behalf of a widow dependent and a dependent child arising out of the death of an employee killed while working on the installation of a gas pipeline near Atmore, Alabama. The lawsuit is filed in the Circuit Court of Escambia County.
  • The uninsured motorist insurance company that issued a policy to our client refused to pay benefits for injuries our client received in a car accident that happened in Muscle Shoals. We have filed suit against the insurance company for breach of contract and bad faith. The case is filed in the Circuit Court of Colbert County, Alabama.
  • The firm recently resolved a products liability case arising out of the failure of both the driver and passenger’s side airbags to deploy in a substantial collision. Tragically, the driver of the car was killed as a result of the wreck. Our workup of the case included the analysis and opinions of one of the leading airbag experts in the United States. The case was filed in the Circuit Court of Greene County, Alabama. The terms and amount of the pro tanto settlement are confidential.
